Terms of Use

1. Who we are

ch.ai ("ch.ai", "we", "us") is a personal, non-commercial project operated from India by Sujith Suresh. These Terms of Use ("Terms") are an agreement between you and us about your use of the ch.ai website and its features ("the Service"). By using the Service, as a guest or with an account, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Entertainment only, not advice

ch.ai is a parody and comedy app. Aunty, Uncle, Sharma ji ka Beta, Dadi, Fufa ji, Black Sheep and the relatives in the guessing game are fictional characters based on common Indian family stereotypes. They are not real people, and any resemblance to an actual person is unintended.

Nothing on ch.ai is medical, mental-health, legal, financial, career, relationship or any other professional advice. Don't make decisions based on what a character says.

ch.ai is not a crisis or emergency service. If you are thinking about harming yourself, or someone is in danger, contact Tele-MANAS on 14416 or 1-800-891-4416 (free, 24x7), iCall on 9152987821, or emergency services on 112.

3. AI-generated replies

Chat replies are generated automatically by an open-source AI language model. We give the characters rules to keep them light and respectful, but AI output can still be inaccurate, inappropriate, repetitive or offensive. We don't review replies before you see them and we don't endorse them. If a reply is offensive or harmful, please report it with the Contact form so we can improve the safeguards.

The service runs within daily usage limits. When they are reached, characters may switch to pre-written replies until the limit resets.

4. Who can use ch.ai

• You must be at least 18 years old to create an account.
• If you are under 18, you may use guest mode only with the permission and supervision of a parent or guardian. We don't knowingly create accounts for, or collect account information from, anyone under 18. If we learn that we have, we will delete it.
• You must be able to form a binding contract under Indian law.

5. Your account

• Give a real email address that you control, and keep your password private. You are responsible for activity on your account.
• One person, one account. Don't create accounts in someone else's name or with someone else's email.
• Tell us through the Contact form if you think your account has been misused.
• You can delete your account at any time from Meri Kundli. This permanently erases your account and the data tied to it, as described in the Privacy Policy.

6. Acceptable use

When using ch.ai, you agree not to:

• post or try to generate anything unlawful, defamatory, obscene, pornographic, paedophilic, invasive of another person's privacy, hateful, or harassing, including content that targets people based on religion, caste, race, ethnicity, gender, sexual orientation or disability;
• share other people's personal information, or use the Service to bully, threaten or impersonate anyone;
• use the Service for anything that threatens the unity, integrity, defence, security or sovereignty of India, public order, or friendly relations with foreign states, or that incites any offence;
• upload or send malware, or try to break, overload, scrape, reverse-engineer or get around the Service's limits and safeguards (including trying to make the characters ignore their rules);
• use bots or automated scripts, or use the Service to build a competing product;
• use ch.ai's characters or replies to mislead people into thinking they come from a real person or organisation.

We may remove content, limit features, or suspend or delete accounts that break these rules, and we may report unlawful activity to the authorities where the law requires it.

7. Your content

You keep any rights you have in the messages you send ("Your Content"). You give us a non-exclusive, royalty-free licence to store, process and display Your Content only to run the Service for you: for example, to send your message to the AI model and save your chat if you have an account. We don't sell Your Content and we don't use it for advertising. Don't send anything you don't have the right to share, and don't send sensitive personal information (such as health, financial or identity documents). The characters can't help with these anyway.

8. Our content

The ch.ai name, the characters, the illustrations, the game and the code are ours (or our licensors'). You may share screenshots and result cards from the app for personal, non-commercial purposes. Don't copy, resell or republish the Service or its artwork without our written permission. ch.ai is not affiliated with, endorsed by or connected to any brand, shop, organisation or person mentioned as part of a joke.

9. Availability and changes

The Service is free and provided "as is" and "as available". We may change, pause or stop any part of it at any time, including the characters, the game, limits and features, without notice. We'll try to keep things running, but we don't promise the Service will be uninterrupted, error-free or secure.

10. Disclaimers

To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. You use the Service, and rely on anything it says, at your own risk.

11. Limitation of liability

To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for any loss of data, profit or goodwill, arising from your use of the Service or from AI-generated replies. Because the Service is free, our total liability to you for any claim is limited to ₹1,000. Nothing in these Terms limits liability that cannot be limited under Indian law.

12. Indemnity

If your misuse of the Service or your breach of these Terms causes a claim against us, you agree to compensate us for the reasonable losses and costs that result, to the extent permitted by law.

13. Ending your use

You can stop using ch.ai and delete your account at any time. We may suspend or end your access if you break these Terms or if we shut the Service down. Sections 7 (licence for content already processed), 10, 11, 12 and 15 continue after your use ends.

14. Grievances and contact

In line with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is:

We will acknowledge a grievance within 24 hours and aim to resolve it within 15 days. Requests to remove content that exposes someone's private parts, shows nudity or sexual acts, or impersonates someone will be acted on within 24 hours.

15. Governing law

These Terms are governed by the laws of India. Any dispute will be subject to the jurisdiction of the competent courts in India. We'll always try to sort things out informally first, so please reach out through the Contact form.

16. Changes to these Terms

We may update these Terms. The version date at the top will change, and if a change is significant we'll show a notice in the app. If you keep using ch.ai after a change takes effect, you accept the updated Terms.
